Terms of Service
Draft — pending legal review. Effective date: [TBD]. These Terms govern your use of WashPass, a service of Campbell Digital LLC, a New Hampshire limited liability company ("WashPass," "we," "us").
1. Acceptance of these Terms
By creating a WashPass account or using the WashPass app, a WashPass kiosk, or this website, you agree to these Terms of Service. If you do not agree, do not use WashPass.
2. Eligibility & accounts
You must be able to form a binding contract to create a WashPass account. You are responsible for keeping your account credentials secure and for activity that occurs under your account.
3. The WashPass wallet — stored value
WashPass lets you load money into a wallet ("stored value") that you can spend at car washes on the WashPass platform. Wallet balances are closed-loop: a balance is redeemable at any location operated by the same car wash operator where you loaded it, but never at a different operator's washes, and never transferred to another person.
If you use WashPass at more than one operator, you hold a separate wallet balance with each one. The app shows each operator's balance distinctly — there is no single, pooled "WashPass balance" spanning different operators.
4. Reloads & refunds
When you add money to your wallet (a "reload"), that reload is non-refundable as cash except as described in this section.
An attendant or the owner at a car wash location can issue a refund of your remaining wallet balance. A refund returns the balance still in your wallet at the time of the refund — not the amount you originally reloaded, and not any part of the balance you have already spent.
Refunds are always initiated by a person at the car wash — never automatically by WashPass. There is no self-service refund button in the app.
5. Suds (promotional credit)
Suds are promotional credit that WashPass or a car wash operator may add to your account — for example, as a bonus for reloading. Suds have no cash value, cannot be redeemed for cash, and cannot be transferred to another person or to a wallet at a different operator. Suds earned from a reload do not expire.
6. No expiration, no dormancy fees
Wallet balances do not expire. WashPass does not charge dormancy, inactivity, or maintenance fees on wallet balances, however long they go unused.
7. Acceptable use
You agree not to misuse WashPass — including attempting to manipulate wallet balances, Suds, or QR codes outside of normal use, or interfering with the operation of WashPass kiosks or the app.
8. Disclaimers
WashPass is provided "as is." We do not guarantee that the service will be uninterrupted, error-free, or available at every car wash location at all times.
9. Limitation of liability
To the extent permitted by law, Campbell Digital LLC is not liable for indirect, incidental, or consequential damages arising from your use of WashPass.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new effective date. Continued use of WashPass after an update means you accept the revised Terms.
11. Governing law
These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws principles.
